The terms of the property location service you are paying for
1. Who you are contracting with
These terms govern the sale of the property location service offered on this website by Paul Michael Holley, NIE X5523288E, registered at Bda. La Ramblica (Rambla de Oria), Caseta Postal 17, Buzón 15, 04811 Oria, Almería, Spain, email info@spainpropertyfinder.net, telephone +34 686 878 789.
By completing the registration form and paying, you accept these terms.
2. What the service is
For twelve months from the date of your payment, we search for property in Spain on your behalf according to the requirements you give us, and send you the properties that match. The service covers Costa Almería, Costa Blanca, Costa del Sol, Murcia, Ibiza and Mallorca.
What is included: a personal conversation about your requirements; access to properties through our network of estate agents in those six regions; properties sent to you as they come up; help arranging viewings; and an invoice for your records.
What is not included: we are not an estate agency, a law firm, a tax adviser or a mortgage broker, and we do not act as your legal representative in a purchase. We do not give legal, tax, financial or investment advice. We recommend you appoint an independent Spanish lawyer before signing anything.
What we cannot promise: we cannot guarantee that a property matching your requirements will become available, nor that any purchase will complete. What you are paying for is the search, carried out with professional diligence for the full twelve months.
3. Price and payment
The price of the service is €110.00 for clients based in the European Union, and £110.00 for clients based in the United Kingdom. Each figure includes Spanish VAT (IVA) at 21 %: a net fee of €90.91 plus €19.09 of IVA, or a net fee of £90.91 plus £19.09 of IVA. You choose the currency on the registration page before paying. This is the final price: nothing is added at checkout.
Payment is made online by PayPal, or by debit or credit card through PayPal. We never see or store your card details. Payment by bank transfer to our bunq account is also accepted; where you pay by transfer, the service starts on the day the funds reach our account.
An invoice showing the fee and the VAT separately is sent to the email address you give us as soon as the payment is confirmed.
You pay us nothing else. Where you buy a property through an estate agent we introduce you to, that agent may share part of their own commission with us. The price of the property is not increased because you came through us.
4. When the service starts, and your right to cancel
As a consumer you have fourteen calendar days to withdraw from a contract made at distance, under Royal Legislative Decree 1/2007.
Because the service begins as soon as we contact you to go through your requirements, the registration form asks you to confirm two things: that you want the service to start immediately, and that you understand that once it has been fully performed you lose the right of withdrawal. That confirmation is recorded with your order.
If you withdraw within the fourteen days and the service has already begun, you will owe an amount proportionate to the work carried out up to that point.
To withdraw, write to info@spainpropertyfinder.net stating your name and order number. We will refund you through the same means of payment within fourteen days of receiving your notice.
5. Duration and renewal
Your registration lasts twelve months from the date of payment. It does not renew automatically: if you want to continue after that, you register again.
6. Your obligations
You agree to give us accurate contact details and requirements, and to tell us if they change. We can only search well for what you have described accurately.
7. Liability
We are liable for performing the search service with professional diligence. We are not liable for the condition, legal status, price or availability of any property, nor for the conduct of any estate agent, seller, lawyer or other third party involved in a purchase.
8. Complaints, applicable law and dispute resolution
Send any complaint to info@spainpropertyfinder.net. We will answer within one month.
These terms are governed by Spanish law. Where you are a consumer, any dispute may be brought before the courts of your place of residence.
